The 2018 Farm Bill removed hemp from the federal definition of marijuana, where hemp means cannabis containing no more than 0.3% Delta-9 THC by dry weight. Erth's disclaimer states that all Erth Wellness, Native Extracts, Arthridiol and Daily Pet Co. products fall under that threshold.
Here is the part worth understanding. The limit is a percentage by weight, not a dose. A heavy gummy can hold a meaningful amount of Delta-9 THC and still sit under 0.3% of its own weight. That is the whole basis of the hemp-derived Delta-9 market, and it is why a 100mg chocolate bar can be sold by post.
So yes, these products can get you high, and yes, they are sold as federally compliant hemp. Both things are true at once, and anyone telling you otherwise is simplifying.
Your state is the part that decides
Erth's own shipping policy says it plainly: state and local laws on Delta-8, Delta-9 and Delta-10 change frequently, and it recommends checking your state's website for current rules.
The shop backs that up in a way most readers miss. There is a state selector in the footer, and what the catalog offers you changes with it. If you are wondering why a product you saw once has vanished, or why a friend in another state can buy something you cannot, that selector is usually the answer.
It also explains one of the more common questions people type about this brand: why Erth is not available in California. The actual restricted-state list
Erth publishes this behind a View State Shipping Restrictions link on its product pages, which is easy to miss. We pulled it on October 25, 2026. It is the single most useful thing on this page, so here it is in full.
Note that the restrictions run per cannabinoid, not per shop. Delta-9 is blocked in six states, Delta-8 in twenty-five, and the kratom line has its own list including named counties.

So what about California
This is the question people actually type, and the answer is more specific than the rumour.
California is on the Delta-8 blocked list. It is not on the Delta-9 list. So the shop's Delta-9 gummies and chocolates are not barred from California by Erth's own restriction table, while its Delta-8 products are.
Separately, Erth received a California Proposition 65 notice in December 2024 over Delta-9-THC warnings, which our legitimacy page covers along with the fact that the warning now appears on product pages. The two things get run together online. They are different issues, and only one of them is a shipping restriction.

What we found: Erth age-gates its site to 21 and over, and you confirm that to enter. We found no indication of identity verification at checkout, and no stated signature-on-delivery or ID-on-delivery requirement in its shipping policy. Orders go out by USPS and UPS like any other parcel.
Treat the age gate as what it is, a confirmation rather than a check. That places the responsibility on the buyer, and it is a reason to be careful about where a parcel lands if anyone under 21 shares your address.

The Road Trip exception
One line in Erth's own disclaimer is worth pulling out, because the product name gives nothing away: Road Trip products contain no THC or hemp or cannabis ingredients at all.
What they are instead is mushrooms. Road Trip Mushroom Co. accounts for 24 of the products in the shop, including Motel Magic Mushroom Gummies and Desert Stardust mushroom chocolate bars at $29.99. A different category again, with its own state rules.
People search for Road Trip gummies and Road Trip reviews assuming they are buying the same category as the rest of the shop. They are not. If you want the THC line, Road Trip is the wrong shelf, and if you want something you can take with none of the above, it is the right one.
